Omnibus Directive. What is it actually?
In this paragraph I will explain to you what changes you can expect in the EU consumer law. In a few words, the Omnibus Directive refers to changes in consumer law related to certain gaps or deficiencies in the current law. It introduces a number of beneficial solutions for consumers, which are aimed at:
- Putting an end to the (unfortunately) common practice of unfair price increases before promotions
- Adapting the law to the new, digital reality
- Ensuring greater transparency for online shopping
- Simplifying the information obligation framework for online shops
When is it coming into force?
The Omnibus directive should be applicable in the legislation of EU Member States from 28 May 2022. As of this date, each online retailer should adapt its regulations and pricing policy to the new legislation. It is May 28, 2022 that the European Union has set as the effective date of the new legislation. Don't miss this date!
Sanctions for non-compliance with the Omnibus Directive
There are sanctions foreseen for not complying with the Omnibus Directive into a business. The amount of the sanction is determined individually for each EU Member State, with at least 4 percent of a company’s annual turnover in the respective country. In extreme cases sanctions for non-compliance with the Omnibus Directive can be as high as 10% of a company’s annual turnover.
