TESTIMONIALS: TERMS & SERVICE
OVERVIEW
The following terms and conditions (“Testimonials Terms and Conditions”) apply to the submission of written, picture or video testimonials (“Testimonials”) for use on this Website (the “Website”). By submitting a Testimonial, you agree to these Testimonial Terms and Conditions. In the case of a conflict between these Testimonial Terms and Conditions and the Site User Terms and conditions, the Site User Terms will take precedence.
SECTION 1 - OWNERSHIP OF TESTIMONIALS
WPDesk.net will hold all of your rights, title, and interest in and to your Testimonial, including all copyrights and other intellectual property rights therein, upon submission of your Testimonial. Upon submission of your Testimonial, you grant WPDesk.net the right to copyright, reproduce, publish, create derivative works of, or otherwise use, in any manner and through any medium that WPDesk.net deems appropriate, for any purpose, anywhere in the world.
SECTION 2 - TESTIMONIAL RELEASE
You agree that by providing a Testimonial, WPDesk.net may use and publish your name, photograph, biographical information, and any other written material you provide, as well as any rights of publicity or personality associated with such use, in any way it deems appropriate in connection with its use of your Testimonial. If your Testimonial is used, you will not receive any financial compensation. In this agreement, you waive any right to approval with respect to the use of your testimonial and any materials created by WPDesk.net related to your testimonial. The Testimonial is not obligated to be used by WPDesk.net, and WPDesk.net may decide not to use your Testimonial (or any derivative work created from it).
SECTION 3 - REPRESENTATIONS AND WARRANTIES
This is a representation and affirmation on your part:
a) you, and only you made your Testimonial voluntarily;
b) it contains your own opinion;
c) it is based on your own experience(s) with WPDesk.net;
d) and it is true and correct to the best of your knowledge.
At any time you wish to retract your Testimonial, you represent and affirm that you will contact WPDesk.net in writing addressed to WPDesk.net if your opinions about WPDesk.net or its services change. You represent and affirm that your beliefs were not influenced in any manner and that, other than as expressed in these Testimonial Terms and Conditions, you have not received nor have been promised anything of value in exchange for making your Testimonial.
SECTION 4 - PRIVACY
Information you provide in connection with your Testimonial will be stored and used in accordance with WPDesk.net’s Privacy Policy.
